The Short Version
We hope you learn and understand First
Aid and CPR, so you can effectively administer both. However, if you
don't and you try to administer either and you injure or kill someone while
trying to perform First Aid or CPR, we will not be held liable.
The Long and Legal Version
To the fullest extent permissible
and pursuant to all applicable laws, neither we nor any other party involved in
producing, creating, or delivering the site is liable for any direct,
incidental, indirect, consequential, or punitive damages coming out of your
access to, or use of, the material or the web site. Without limiting the
foregoing, everything on the site is provided to you "AS IS", without
warranty of any kind, either expressed or implied, including, but not
limited to, the implied warranties or merchantability, fitness for a
particular purpose, or non-infringement. We shall have absolutely no
liability in connection with the services including without limitation, any
liability for damage or injury to you or your business resulting from the
material or the lack of information available on the site. Additionally, we
shall have no liability for any loss or injury caused, in whole or in part,
by our actions, omissions, or negligence, in procuring, compiling, or
delivering the material; any errors, omissions, or inaccuracies in the
material regardless of how caused, or delays or interruptions in delivery of
the material; or any decision made or action taken or not taken in reliance
upon the material furnished at this site.
The law requires that a victim give
consent to an offer of help before a trained rescuer gives assistance.
However, the law assumes that an
unconscious person would give permission. If victim is conscious, the
rescuer must ask for consent before giving help. Consent is implied if
the victim is unconscious, badly injured with a life-threatening injury, or a
person so ill that they cannot respond. A rescuer should make a reasonable
attempt to receive permission from a parent or guardian if the victim is a
minor or who is mentally or emotionally disturbed. If a parent or guardian
is not available, the rescuer may give aid without consent.
Generally, State "Good Samaritan" laws provide rescuers with legal protection
as long as the rescuer acts in "good faith" and is not acting with gross
negligence or willful misconduct. The scope of protection concerning these
laws vary from state to state and the rescuer should be familiar with the
specifics of their own state's laws.
